Tronox Mineral Sands (Pty) Ltd (Tronox) Namakwa Sands Operation undertakes the mining and beneficiation of heavy minerals. Tronox held an Atmospheric Emission Licence (AEL) for operations at its Smelter at the Tronox Namakwa Sands Operations near Saldanha/Vredenburg, Western Cape.
The AEL was for the following listed activities, in terms of Section 21 of the National Environmental Management: Air Quality Act 39 of 2004 (NEM:AQA):
An AEL Renewal Application was submitted to the licensing authority (in this case, the West Coast District Municipality [WCDM]) in terms of Section 47 of the NEM:AQA. Tronox has appointed SRK Consulting (South Africa) (Pty) Ltd (SRK) to undertake the AEL Renewal Application process.

On 23 February 2024 and in terms of the NEM:AQA, the WCDM granted the renewal of the AEL to Tronox for the Smelter. The granting of the renewed AEL is subject to a number of conditions which, along with the reasons for the decision, are set out in the AEL (see below).
In terms of Section 40(4)(c) of the NEM:AQA, Section 62 of the Municipal Systems Act 32 of 2000, as amended and the appeal instructions from the WCDM, any person wishing to appeal against the decision must submit an appeal to the WCDM Manager within 21 days of the date that the notification of the decision (i.e. by 22 March 2024) was issued to the registered interested and affected parties.
